RENTAL TERMS AND CONDITIONS



Introduction

Please ensure that you read and understand the following terms and conditions pertinent to
your accommodation rental. If you have any queries, please do not hesitate to contact us.
Submission of a booking form by you is your express agreement to all of the following.
Your holiday home rental includes accommodation as booked including services i.e. gas,
water and electricity. Not included in our rental prices are flights, car hire or holiday
insurance. Spa heating can be arranged at additional cost, as can the hire of high chairs,
cots/cribs and barbecues.

1. Your Holiday Booking

1.1 Confirmation of Booking

The villa is offered for holiday rental subject to confirmation by the Owners to the renter
(the Guest).To reserve the villa the Guest should complete and sign the Booking Form and
return it together with payment of the initial non-returnable Deposit. On receipt of Booking
Form and Deposit, the Owners will send confirmation. This is the formal acceptance of the
Booking.

1.2 Number of Guests

No more than 8 persons are permitted to stay at the Villa during the rental period unless
prior written permission has been obtained from the owners. The villa is reserved for the
exclusive use of the Guests named on the Booking Form and no other persons are permitted
to stay without prior written permission from the owners.

1.3 Arrival and Departure

Check in time is from 4.00pm on the day of arrival.
Check out time is before 10.00am on the day of Departure.
The Owners are not obliged to offer the villa before the time stated and the Guests are not
entitled to remain after the departure time stated. The Owners reserve the right to make
any deductions from the Security Deposit if this condition is not met.

2. Payment

2.1 Initial Non-returnable Deposit

A $200 per week reservation deposit must accompany the signed Booking Form. Without
this the Booking will not be confirmed. This Deposit is strictly nonrefundable except where
laid out in section 3.2 of these Booking Conditions. A larger deposit will be required at the
owner's discretion for longer term rentals.

2.2 Balance of Payments

The outstanding balance of Payment must be paid in full 8 weeks prior to the
commencement of the rental period. The Owners reserve the right to cancel the booking
where full payment has not been received 8 weeks prior to the commencement date. Any
bookings made within 8 weeks of the commencement date require full payment with the
Booking Form.

2.3 Security Deposit

We don’t take a Security Deposit. But the guest will be liable for any expenses incurred by
the Owners as a result of any breakages/ damage to the property or environs or for any
inventory damage and excessive cleaning costs, TV film hire or any other expense incurred
by the Owners accountable to the Guest.

2.4 Payment Methods

Cheque (For US booking we can only accept a US dollar cheque drawn on a US bank
account).
Bank Transfer of Funds (When making the transfer you must ensure that you pay all the
transfer charges, your bank and ours, such that we receive the full amount of the agreed
rental).
PayPal (credit card). There is a 3% fee for PayPal payment.
3. Cancellations
If the Guest wishes to cancel a Booking, the Guest must inform the Owners in writing. All
cancellations will be subject to a charge payable by the Guest as set out in the cancellation
schedule below.

3.1 Cancellation Schedule

More than 8 weeks prior to the rental date - Deposit only.
Between 6-8 weeks prior to the rental date - 50% of rental charge.
Less than 6 weeks prior to the rental date - 100% of rental charge.

3.2 Cancellations by the Owners

In exceptional circumstances the Owners reserve the right to cancel the booking in whole or
part without penalty. In such a case the Guest will receive all of the monies paid, including
the non-refundable deposit. Every effort will be made to find similar accommodation.

4. Guests Responsibility

4.1 The Guest agrees to take good care of the villa and behave in a responsible manner. The
villa must be left in a clean and tidy condition, although a final clean is included in the
charges, the Owners reserve the right to make deductions from the security deposit to
cover any additional cleaning costs incurred if the Guest leaves the Villa in an unacceptable
condition.

4.2 The Guest agrees not to act in any way which may cause offence or disturbance to
residents in the neighboring community. If in the opinion of the Owners or their selected
representative it is thought that the Guest is causing a disturbance to residents in
neighboring properties, the Owner has the right to terminate the Booking without notice or
compensation or refund of any monies paid.

4.3 The Guest must report any defects to the property or environs, or any breakdown in any
equipment or appliance to the Owners representatives at the earliest opportunity.

4.4 In the case of repair or maintenance, the Owners representatives have the right to enter
the Villa either indoor or Outdoor accompanied by professional workmen upon giving
advance notice to the Guest.

4.5 Sub Letting. The accommodation is reserved exclusively for the people named on the
booking form and no other persons whatsoever are permitted to stay there unless this has
been agreed with the owners or their agents in writing.

5. Insurance

5.1 The Owners strongly advise that the Guest arranges adequate Insurance Cover (including
cancellation cover) and has cover for all the Guests listed on the Booking Form, their
belongings, public liability and adequate health insurance for the US as these are not
covered by the Owners insurance.

5.2 The Owners are not responsible for any deaths, injuries, illness, accidents, including
motor vehicles, to any Guests however caused.

6. Owners Liability Disclaimer

The Owner shall not be liable for the following:

6.1 Force Majeure - Any loss, damage or injury caused or suffered by the Guest which is the
result of weather conditions, riot, civil or military unrest. War, strikes, fire, natural disasters,
building work or any other eventuality which is beyond the control of the Owner. Any
additional expense incurred by the Guest as a result of such conditions shall be the
responsibility of the Guest and as such shall not be reimbursed, nor will any services lost
thereby be recoverable.

6.2 Any loss, damage or inconvenience caused or suffered by the Guest if the villa shall be
destroyed or substantially damaged before the commencement of the Booking Period. In
any such event, the Owner shall, within 7 days of notification to the Guest, refund to the
Guest all sums previously paid in respect of the Booking Period, including the initial nonreturnable
Deposit.

6.3 Any temporary defect or stoppage in the supply of local services to the villa, nor in any
respect of any equipment, plant, machinery or appliance in the property itself, its grounds
or swimming pool. Under no circumstances shall the Owners' liability to the Guest exceed
the amount paid for the Booking Period.

6.4 Safety. The owners of the property or their agents cannot accept any responsibility
whatsoever and howsoever caused for injury or damage caused as a result of the use of the
pool and the surrounding area. Guests are specifically requested not to allow children to use
the pool unless supervised by a responsible adult. Please note that tampering with pool
equipment and door alarms is a criminal offence.

6.5 Any item listed as being available may be withdrawn at any time due to circumstances
beyond the control of the owners.

7. Jurisdiction

In the unlikely event of any dispute, the competent jurisdiction shall be the court of Florida.
A reservation implies the Guest's knowledge and acceptance without reserve or exception
of the Booking Policy here set forth. If any of the conditions of the contract were or should
become invalid, or if there should occur any omission, the validity of the remaining
conditions will not be subject to litigation.
